Terms of Service

1. Agreement

By accessing or using HaloBands (“the Service”), you agree to be bound by these Terms of Service. The Service is operated by Neo-2 Consulting Limited, based in Saskatoon, Saskatchewan, Canada.

2. The Service

HaloBands provides NFC-enabled wearable bands paired with a digital platform for storing and sharing memories including photos, videos, voice recordings, and text. The Service includes the physical band, cloud storage, mobile applications, and web-based memory viewer.

3. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 13 years of age to use the Service. If you are under 18, you must have parental or guardian consent.

4. Content

You retain ownership of all content you upload to the Service. By uploading content, you grant HaloBands a limited license to store, process, and display your content as necessary to operate the Service. You are solely responsible for the content you upload and must not upload content that is illegal, harmful, or infringes on the rights of others.

5. Purchases & Payments

All purchases are processed securely through Stripe. Prices are in USD and include applicable taxes where required. Physical bands ship within 5-7 business days. Digital features are available immediately upon purchase. All sales are final. We may offer refunds at our discretion within 30 days of purchase for defective products.

6. Subscriptions

Cloud storage subscriptions renew automatically. You may cancel at any time from your account settings or the app. Upon cancellation, your content remains accessible until the end of your billing period. Free tier users receive limited storage. We will notify you before deleting any content due to account inactivity.

7. Memorial Content

Memorial bands may contain content related to deceased individuals. The band owner is responsible for ensuring they have appropriate rights to share such content. Memorial bands with public guestbooks allow contributions from visitors — we reserve the right to remove inappropriate guestbook entries.

8. Privacy

Your privacy is important to us. Please refer to our Privacy Policy for details on how we collect, use, and protect your information.

9. Limitation of Liability

HaloBands is provided “as is” without warranties of any kind. Neo-2 Consulting Limited shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Governing Law

These terms are governed by the laws of the Province of Saskatchewan, Canada. Any disputes shall be resolved in the courts of Saskatchewan.

11. Changes

We may update these terms from time to time. We will notify users of significant changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance.
